Data protection

In this privacy statement, we, Kuhn Schweiz AG [a Kuhn Group company] (hereinafter referred to as The Kuhn Company, we or us), explain how we collect and otherwise process personal data. This is not an exhaustive description; other data protection declarations [or general terms and conditions, conditions of participation and similar documents] may govern specific matters. This privacy statement is designed to meet the requirements of the EU General Data Protection Regulation ("GDPR"), the Swiss Data Protection Act ("DPA") and the revised Swiss Data Protection Act ("revDSG"). However, whether and to what extent these laws are applicable depends on the individual case.

    No personal data is collected on this website unless you provide it to us voluntarily (e.g. by ordering the newsletter, enquiries to our company). The data you provide will only be used for the purposes stated in each case, e.g. newsletter dispatch, processing the enquiry or for contract processing. We will only collect the data from you that is necessary to fulfil these purposes. Data collection for marketing purposes only takes place with your express consent.

    The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. This is the case when the respective conversation with the user has ended. The conversation is terminated when it can be inferred from the circumstances that the matter in question has been conclusively clarified. Furthermore, the statutory archiving obligations apply. In accordance with the relevant data protection regulations and data protection guidelines, Kuhn ensures appropriate technical and organisational measures for adequate security in the processing of personal data.

    When you visit this website, information ("cookie") is stored on your computer that allows the website to recognise you on subsequent visits. This allows the website to be optimally adapted to your interests. If you do not agree to the storage of cookies on your computer, please deactivate the use of cookies in your browser. However, we would like to point out that in this case you may not be able to use all the functions of this website to their full extent.

    Every time you visit our website, data about this process is recorded in a log file. This information is not linked to personal data, so that your identity cannot be inferred from the recording of this data. This recording is only done in the context of improving our website. The access data includes: Name of the accessed website, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page), IP address and the requesting provider.

    This website uses Google Analytics, a web analytics service provided by Google, Inc ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookies about your use of this website is usually transmitted to a Google server in the USA and stored there. However, in the event that IP anonymisation is activated on this website, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.     We only process the applicant data for the purpose of and within the scope of the application procedure in accordance with the legal requirements. Applicant data is processed to fulfil our (pre-)contractual obligations within the scope of the application procedure within the meaning of Art. 6 (1) lit. b DSGVO or Art. 6 (1) lit. c DSGVO if data processing becomes necessary for us, e.g. within the scope of legal proceedings.

    The application procedure requires that applicants provide us with the applicant data. The necessary applicant data is marked if we offer an online form, otherwise it results from the job descriptions and basically includes personal details, postal and contact addresses and the documents belonging to the application, such as cover letter, CV and certificates. In addition, applicants can voluntarily provide us with additional information.

    By submitting an application to us, applicants consent to the processing of their data for the purposes of the application process, in accordance with the nature and scope set out in this privacy policy.

    Insofar as special categories of personal data within the meaning of Art. 9 (1) DSGVO are voluntarily provided within the scope of the application procedure, their processing is additionally carried out in accordance with Art. 9 (2) lit. b DSGVO (e.g. health data, such as severely disabled status or ethnic origin). Insofar as special categories of personal data within the meaning of Art. 9 (1) DSGVO are requested from applicants as part of the application process, their processing is additionally carried out in accordance with Art. 9 (2) a DSGVO (e.g. health data if this is necessary for the exercise of the profession).

    If provided, applicants can submit their applications to us using an online form on our website. The data is transmitted in encrypted form in accordance with the state of the art. Applicants can also send us their applications by e-mail. Please note, however, that e-mails are generally not sent in encrypted form and applicants must ensure that they are encrypted themselves. We cannot therefore accept any responsibility for the transmission path of the application between the sender and receipt on our server and therefore recommend rather using an online form or sending by post.

    The data provided by applicants may be further processed by us for the purposes of the employment relationship in the event of a successful application. Otherwise, if the application for a vacancy is unsuccessful, the applicants' data will be deleted. Applicants' data will also be deleted if an application is withdrawn, which applicants are entitled to do at any time.

    Subject to a justified revocation by the applicant, deletion takes place after the expiry of a period of six months so that we can answer any follow-up questions about the application and fulfil our obligations to provide evidence under the Equal Treatment Act. Invoices for any reimbursement of travel expenses will be archived in accordance with tax law requirements.
     

    As part of the application process, we offer applicants the opportunity to be included in our "job subscription" for a period of two years on the basis of consent within the meaning of Art. 6 Para. 1 lit. b. and Art. 7 DSGVO.

    The application documents in the talent pool will be processed solely in the context of future job advertisements and the employee search and will be destroyed at the latest after the deadline. Applicants are informed that their consent to be included in the talent pool is voluntary, has no influence on the current application process and that they can revoke this consent at any time for the future and declare their objection within the meaning of Art. 21 DSGVO.

    By means of an informal request, you can obtain information about the personal data stored and/or processed by Kuhn Schweiz AG at any time by sending an e-mail to personalwesen@kuhn-gruppe.ch.
    Applications are processed within one month and the applicant is informed in writing about the measures taken after the processing process has been completed. If there are delays due to the complexity of the application or due to the high number of applications received (max. another two months after the one-month deadline), you will be informed immediately. In principle, applications are free of charge. However, in the event of excessive or obviously unfounded applications, Kuhn reserves the right not to process them or to process them only against payment of a fee of CHF 120.00 per working hour required. Should data be necessary for the assertion, exercise or defence of legal claims or for the fulfilment of contractual obligations, the request for deletion can only be processed after the compellingly necessary reasons for storage have ceased to exist. In cases of doubt, the Kuhn company reserves the right to request proof of identity for security reasons.

    In addition, every data subject has the right to enforce his or her claims in court or to lodge a complaint with the competent data protection authority.  The competent data protection authority in Switzerland is the Federal Data Protection and Information Commissioner (http://www.edoeb.admin.ch).

    Based on our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f.
